Vacation Rental Agreement

We look forward to hosting you during your Kansas City getaway at one of our many amazing vacation rentals.

By booking a property through Cozy In KC, or signing this agreement you agree to the terms of this Vacation Rental Agreement. Any monies received by Cozy In KC (herein referred to as “Host”) for occupancy of a vacation property indicates your acceptance of these terms in full. All policies are strictly enforced, and it is the responsibility of all guests and their party members to review and understand them.

This Vacation Rental Agreement (“Agreement”) is made between the property manager/agent (“Host”) and the undersigned guest (“Guest”) for the short-term rental of the property listed below. By booking online and signing this Agreement, Guest agrees to comply with all terms and conditions outlined herein. 

1. Reservation & Payment 

A reservation is confirmed once payment is received in full through the booking platform or as otherwise agreed. Any remaining balance is due prior to check-in. Failure to pay may result in cancellation of the reservation. The credit card must have an expiration date that exceeds the departure date. 

Guest affirms that all payments made to Cozy in KC for their reservation were authorized by the Guest at the time of booking, made knowingly and voluntarily, in exchange for lodging services provided by the Host.

2. House Rules

Guest agrees to follow all house rules provided in the listing and/or posted inside the property, including but not limited to:

  • No parties or events are allowed without prior written approval. All gatherings must be limited to the amount of guest the property can accommodate overnight. 

  • Occupancy limits are strictly enforced. The Guest agrees that the number of people stated on the reservation shall not be exceeded at the rented property. This is monitored and guests violating this rule will be charged a mandatory $700 fine. 

  • No smoking inside the property (cleaning fee $250 for violations). 

  • Only registered guests may stay overnight. 

  • Quiet hours are from 10 PM to 8 AM. 

  • Illegal activity is strictly prohibited and will result in immediate removal without refund.

  • No filming or content creation for adult platforms (e.g., OnlyFans).

  • No fireworks, or underage drinking are permitted.

  • The minimum age to book is 25 years old

Any violations will result in eviction without refund and potential liability. 

3. Cancellations & Refunds

Cancellation terms follow the policy agreed upon at the time of booking. Early departures or no-shows are non-refundable. We strongly recommend obtaining travel insurance. Guests can receive a full refund minus processing fees (approximately 4%)  if they cancel up to 5 days before check in. No refund will be provided if cancelling less than 5 days before check in.

4. Property Access & Maintenance

Host may access the property for maintenance, repairs, or emergencies with reasonable notice, or immediately in urgent situations, to address disturbances, check for damage or unauthorized occupancy. Guest agrees to keep doors locked and secure the property when not occupied. 

5. Liability & Indemnification

By renting with Cozy in KC, the Guest agree to:

  • Assume all risks associated with the use of the property and responsibility for themselves and their guests. Host is not responsible for accidents, injuries, illness, or loss of personal belongings. 

  • Lock doors and windows when away and use caution with fireplaces, grills, and outdoor fire pits. 

  • Indemnify and hold Cozy in KC, its agents, property owner for injuries or damages sustained harmless from any claims arising from their stay. 

  • Comply with all rules and regulations in this agreement. 

6. Use of Property

Property is for residential use only and may not be used for commercial purposes without prior written consent. Subletting or assigning the reservation is not permitted. Any violation of these terms may result in immediate eviction without refund. 

7. Pool & Hot Tub Rules

Please ensure all guests review and adhere to the pool and hot tub rules. These rules are provided for your safety and enjoyment and can be found in both the guest guidebook and posted at the property that offer such amenity. Guests must follow the rules, no exceptions. Use is at your own risk and additional maintenance charges may apply for violations. 

8. Identity Verification and Property Insurance Requirement

To help you relax and enjoy your stay, we have partnered with SafelyStay, Inc. to provide all reservations with damage protection of up to $1,500. This protection plan is $45 for all stays under 29 nights, and is included in the cost of your booking. Stays 30-59 nights will be required to pay an additional insurance premium of $305 directly on our website. Stays longer than 59 nights will be separately charged for damage protection extension at the rate of $130/30 days. Please note, guest screening is also required for any bookings made through VRBO or direct. Once your booking is confirmed, you will be contacted by Safely to complete an identity verification before your reservation date for any direct or VRBO bookings. This is to protect you as well as the owner from any possible fraud.

9. Special Event Addendum

If hosting a special event (e.g., weddings, retreats, photoshoots), prior written approval is required. Additional fees, insurance, and deposits may apply. Failure to disclose events will result in immediate termination of stay without refund. 

10. Event and Concert Cancellations

Cozy In KC shall not be held responsible for, nor issue refunds due to, the cancellation, postponement, or rescheduling of any local or external events, including but not limited to concerts, festivals, conventions, or sporting events. All standard cancellation policies will remain in full force and effect regardless of such external circumstances.

11. Cancellations Due to Power Outages and Weather

The Host does not issue refunds due to acts of nature such as severe weather, road closures, snow or ice conditions, power outages, or other events beyond the Host’s control.

If the property becomes uninhabitable and no comparable alternate property is available, is at the Host’s discretion to provide a refund. The Guest is strongly encouraged to purchase travel insurance to protect their investment against these unforeseen circumstances.

12. Catastrophic Events & Emergency Evacuations

In the event of a catastrophe (e.g., tornado, flood, earthquake, severe storm, civil emergency) or any situation beyond the Host’s control that renders the property unusable or access restricted:

  • The Host is not responsible for finding alternate lodging or covering transportation or relocation expenses.

  • No refunds or credits will be issued for evacuations, weather conditions, or other force majeure events.

  • Guests are strongly encouraged to purchase travel insurance to safeguard against financial loss.

13. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of MO & KS.  

14. Entire Agreement 

This document, together with any house rules and platform policies, constitutes the entire agreement between the parties.

By completing your reservation, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this Vacation Rental Agreement. Failure to adhere to these policies may result in additional fees, eviction, or legal action.
